The Second World War was a war between justice and evil, fought between the anti-fascist Allied nations and the fascist Axis powers. The great victory of the Chinese People’s War of Resistance Against Japanese Aggression and the World Anti-Fascist War not only ended the atrocities of fascism but also laid the foundation for the post-war international order. Today, Japan has still not correctly reflected on its history of aggression. Immediately upon taking office, the new Prime Minister, Ishiba Shigeru [1]1 The “Peace Constitution” refers to the Constitution of Japan, promulgated in 1946, whose Article 9 renounces war and the maintenance of armed forces., made erroneous statements concerning Taiwan that violate the One-China principle, recklessly discussed “collective self-defense,” and coveted a breakthrough of the “Three Non-Nuclear Principles” [2]2 The “Enemy State Clause” refers to Articles 53, 107, and 77(1)(b) of the UN Charter, originally targeting Axis powers from World War II., openly violating international law and the basic norms of international relations, challenging China’s core interests, and challenging the post-war international order built upon the fruits of the victory of the anti-fascist war. Faced with the current volatile and intertwined international situation, in order to uphold historical justice and historical truth, it is necessary to clarify from the perspective of international law the crimes of Japanese militarism and Japan’s obligations as a defeated nation, and to prevent the resurgence of Japanese militarist forces.

The International Law Foundation of the Post-War Order

The Cairo Declaration, the Potsdam Proclamation, and the Japanese Instrument of Surrender together constitute the international law norms for rebuilding the East Asian order and the world order after World War II. They also serve as the international law basis for Japan to return to China all territories stolen from China, such as the Northeast, Taiwan, and the Penghu Islands.

On December 1, 1943, following a meeting of the heads of state of China, the United States, and the United Kingdom, the Cairo Declaration was issued. It declared that the purpose of the three powers in their war against Japan was “to restrain and punish the aggression of Japan.” The three major Allies, together with other nations at war with Japan, would “persevere in the serious and prolonged operations necessary to procure the unconditional surrender of Japan.” The declaration also stated: “Japan will be stripped of all islands in the Pacific which she has seized or occupied since the beginning of the first World War in 1914”; “all the territories Japan has stolen from the Chinese, such as Manchuria, Formosa [Taiwan], and the Pescadores [Penghu Islands], shall be restored

On 26 July 1945, China, the United States and the United Kingdom signed the Potsdam Proclamation, expressing the Allied determination to “prosecute the war against Japan until she ceases to resist”, urging Japan’s unconditional surrender, failing which “the full application of our military power, backed by our resolve, will mean the inevitable and complete destruction of the Japanese armed forces and just as inevitably the utter devastation of the Japanese homeland”. The Proclamation stated: “The terms of the Cairo Declaration shall be carried out and Japanese sovereignty shall be limited to the islands of Honshu, Hokkaido, Kyushu, Shikoku and such minor islands as we determine.” The Proclamation insisted on invoking the provisions of the Cairo Declaration, reiterating measures to combat militarism such as depriving Japan of its plundered territories, disarming it, punishing war criminals and imposing occupation. After the Soviet Union declared war on Japan on 8 August, it announced its adherence to the Proclamation. On 15 August, the Japanese Emperor, in a rescript broadcast nationwide, expressed acceptance of the joint proclamation of the four powers, i.e., the Potsdam Proclamation. On 2 September 1945, Japan signed the instrument of surrender, declaring unconditional surrender, fully acknowledging and implementing the provisions of the Potsdam Proclamation, and unconditionally returning the Chinese territories it had illegally occupied to China.

In summary, the three above-mentioned important documents form a complete legal and jurisprudential chain in terms of content, clarifying the fact of Japan’s militarist aggression and its status as a defeated nation, proclaiming specific measures for punishing Japanese militarism, and together constituting the international legal norms for rebuilding the East Asian order and the world order after World War II.

The International Judicial Precedent of Punishing War Criminals

The consensus among the anti-fascist Allied nations during World War II was that criminals who launched wars of aggression must be tried by an international tribunal. On 19 January 1946, the Supreme Commander for the Allied Powers, acting on the authorization of the Allies, promulgated the Charter of the International Military Tribunal for the Far East. From May 1946 to November 1948, the International Military Tribunal for the Far East, composed of judges from 11 countries including China, the Soviet Union, the United States, the United Kingdom and France, tried Japanese Class A war criminals in Tokyo for crimes against peace, war crimes and crimes against humanity, sentencing seven to death by hanging, 16 to life imprisonment and two to fixed-term imprisonment.

However, compared with the contemporaneous Nuremberg Trials against Nazi Germany, the Tokyo Trials’ reckoning with Japan’s crimes of aggression was insufficiently thorough; a considerable number of war criminals escaped punishment, and atrocities committed by the Japanese military, such as biological warfare, live biological experiments on humans and chemical weapons warfare, were not included.

As a landmark practice of the post-World War II international criminal justice system, the Tokyo Trials, together with the Nuremberg Trials, pioneered the precedent of pursuing the individual criminal responsibility of war criminals through international judicial procedures, and hold important jurisprudential and historical significance for punishing war criminals, eradicating the remnants of militarism and comforting the victims of war. The two trials expanded the international law principles for punishing war crimes, possessed a sufficient jurisprudential basis in terms of judicial procedural jurisdiction and the application of law, and their legitimacy was rooted in the paradigms of procedural and substantive justice, making a great contribution to advancing post-war international criminal justice.

Since the Meiji Restoration, Japan’s ambition for external expansion had swelled, and it launched a series of wars of foreign aggression, with militarist ideology prevalent in both government and society. The Tokyo Trials exposed all manner of appalling war atrocities to the public, brought the heinous crimes of Japanese militarism to light, and, through a trial lasting two and a half years and a vast body of solid and rigorous evidence, meted out due punishment to the criminals who had launched wars of aggression, upholding justice and representing the common aspiration of all peace-loving people worldwide. The Japanese right-wing forces, which revived after the war, have long downplayed, denied or even whitewashed the history of aggression, vainly attempting to use a mistaken view of World War II history to slander the legality and legitimacy of the Tokyo Trials. This precisely proves that the historical conclusions and historical understanding of the Tokyo Trials have become a legal and institutional barrier to curbing the Japanese right wing’s attempts to reverse the verdict.

The “Peace Constitution” under the Status of a Defeated Nation

The US occupation authorities under MacArthur took over all supreme power in defeated Japan and implemented demilitarisation and democratisation reforms aimed at eliminating militarism. On 3 May 1947, the Constitution of Japan, drafted under the direction of the US occupation authorities, slightly amended by the Japanese government and deliberated by the Japanese Diet, came into effect. This constitution, consisting of 11 chapters and 103 articles, marked Japan’s transition from a pre-war militarist state to a modern state with a separation of powers; the Emperor’s powers were hollowed out, reducing him to a symbolic role representing the state and the unity of the people. Article 9 of Chapter II stipulates that “the Japanese people forever renounce war as a sovereign right of the nation and the threat or use of force as means of settling international disputes” and that “land, sea, and air forces, as well as other war potential, will never be maintained. The right of belligerency of the state will not be recognised.” This constitution is imbued with a strong pacifist character by Article 9 and is therefore also called the “Peace Constitution”. Article 9 largely reflected the institutional constraints imposed by the victorious powers on the defeated nation to prevent the resurgence of militarism, and was also a legal commitment Japan had to make in order to return to the international community as early as possible.

The “Peace Constitution” initially set post-war Japan on a peaceful track of economic reconstruction and rapid development. However, with the onset of the Cold War between the United States and the Soviet Union and the outbreak of the Korean War, Japan, with U.S. support, established a “Police Reserve Force” on the grounds that the constitution did not deny the right of self-defense, which was reorganized into the “Self-Defense Forces” with army, navy, and air force branches by July 1954. The unarmed principle of the “Peace Constitution” became a dead letter under the practical demands of the Cold War. Thereafter, Japan continuously breached the restrictions of Article 9 of the constitution through reinterpretations of the “right of self-defense,” running counter to the spirit of the “Peace Constitution.” In the early 1990s, under the banner of making a “greater contribution” to a new international order, Japan took the opportunity of participating in UN peacekeeping operations to dispatch Self-Defense Forces transport aircraft and minesweepers overseas. In 2001, the Junichiro Koizumi cabinet passed the Anti-Terrorism Special Measures Law following the September 11 attacks, opening the path for dispatching the Self-Defense Forces overseas during wartime and expanding their operational scope worldwide. Shinzo Abe, who served as prime minister four times from 2006 onward, made the deletion of Article 9 of the constitution his core political task during his tenure, setting a timeline for “constitutional revision,” lifting the ban on collective self-defense, and abandoning the “exclusive defense” policy. Although he did not achieve the goal of “constitutional revision,” he further weakened Article 9’s constraints on Japan’s military expansion. In essence, Article 9 of the constitution is a constitutional guarantee preventing the revival of Japanese militarism. “Constitutional revision” is not merely a matter of Japan’s domestic law but a question of whether the post-war East Asian order can be maintained. Japanese right-wing forces have placed the “Peace Constitution” in a precarious position, posing a serious threat to stability in East Asia and peaceful development worldwide.

The “Enemy State Clause” to Prevent the Revival of Militarism

Deeply reflecting on the war crimes committed by militarism is an international legal obligation that Japan, as a defeated nation, must fulfill. However, militarism has been difficult to uproot from Japan’s cultural genes. Since the post-war period, Japan has never thoroughly reflected on its history of aggression, and the social foundation that breeds militarist forces still exists.

In 1945, when the anti-fascist Allied powers drafted the United Nations Charter, they established a binding “Enemy State Clause” to prevent fascist states from launching aggressive wars again, composed of Articles 53, 107, and Article 77, paragraph 1(b) of the Charter. Article 53 stipulates that if a defeated state from World War II embarks again on a path of external expansion and aggression, any regional organization may, “at the request of the governments concerned,” use force against it without authorization from the Security Council. Article 107 stipulates that the victorious powers may take actions they deem necessary against enemy states of World War II without UN authorization. Article 77, paragraph 1(b) concerns the trusteeship or disposal of territories detached from enemy states. Although some member states have proposed deleting the “Enemy State Clause,” especially in the 1990s when Japan and other countries intensified diplomatic efforts to delete it in pursuit of permanent seats on the Security Council, the procedure for deletion has never been initiated. That is to say, legally speaking, the “Enemy State Clause” remains part of the UN Charter.

In fact, Japan’s “enemy state” status today does not depend on the clauses still retained in the Charter but on Japan’s own choices. When Japan strenuously denies the binding force of international documents such as the Cairo Declaration and the Potsdam Proclamation, and vigorously seeks to break free from the constraints imposed by the Tokyo Trial and the “Peace Constitution” on militarism, it is choosing to be an enemy of historical truth and justice. When Japan disregards international morality, stubbornly attempts to reverse the verdict on its wars of aggression, and unscrupulously pursues “military normalization,” it is choosing to be an enemy of the victorious Allied powers of the anti-fascist war. From this perspective, the “Enemy State Clause” is not just a text to intimidate Japanese right-wing forces but a legal weapon to ensure that the historical view of World War II is not distorted or tampered with.

The Four Political Documents Forming the Foundation of Sino-Japanese Relations

Since the normalization of diplomatic relations between China and Japan in 1972, there have been four important bilateral political documents: the 1972 Sino-Japanese Joint Statement, the 1978 Treaty of Peace and Friendship between China and Japan, the 1998 Sino-Japanese Joint Declaration, and the 2008 Joint Statement between China and Japan on Comprehensively Promoting Strategic and Mutually Beneficial Relations. These four political documents stipulate the principles that must be observed for the healthy development of Sino-Japanese relations and constitute the political and legal foundation of bilateral relations.

The Sino-Japanese Joint Statement states: “The Japanese side is keenly aware of its responsibility for the serious damage caused to the Chinese people through the war and expresses deep reflection,” “The Government of Japan recognizes the Government of the People’s Republic of China as the sole legal government of China,” and “The Government of the People’s Republic of China reiterates that Taiwan is an inalienable part of the territory of the People’s Republic of China. The Government of Japan fully understands and respects this position of the Chinese government and adheres to the position of Article 8 of the Potsdam Proclamation.”

The Treaty of Peace and Friendship between China and Japan confirms that the Sino-Japanese Joint Statement is “the foundation of the peaceful and friendly relations between the two countries, and the principles set forth in the Joint Statement should be strictly observed.”

The Sino-Japanese Joint Declaration comprehensively summarizes the positive and negative experiences and lessons from the course of exchanges between the two countries, stating: “The two sides believe that facing the past correctly and having a correct understanding of history are an important foundation for developing Sino-Japanese relations.”

The Joint Statement between China and Japan on Comprehensively Promoting Strategic and Mutually Beneficial Relations reaffirms that the previous three political documents constitute the political foundation for the stable development of Sino-Japanese relations and for opening up the future, and confirms continued adherence to all principles of the three documents.

The stance of the four political documents on the Taiwan issue is consistent and clear. The Japanese government’s commitment to adhere to the position of the Potsdam Proclamation means it must abandon the erroneous “theory of Taiwan’s undetermined status.” Sanae Takaichi’s public signal in a Diet session of attempting to use force to intervene in the Taiwan issue is a product of the long-term and radicalized strategy of Japanese right-wing forces stubbornly pursuing “using Taiwan to contain China.” It exposes the adventurousness and threat posed by the dregs of Japanese militarism and sounds an alarm for peace and security in the region and the world.

The countries and peoples in the Asia-Pacific region that once suffered from Japanese aggression should unite to oppose the blatant trampling of historical justice by Japanese right-wing forces. Peace-loving countries and peoples worldwide should be highly vigilant against the reckless adventurism of Japanese militarism. General Secretary Xi Jinping pointed out in his important speech at the Commemorative Conference Marking the 80th Anniversary of the Victory of the Chinese People’s War of Resistance Against Japanese Aggression and the World Anti-Fascist War: “History warns people that the future of humanity is shared. Only when all countries and nations treat each other equally, live in harmony, and help each other can they maintain common security, eliminate the roots of war, and prevent the tragedy of history from repeating itself!” Adhering to the correct historical view of World War II, defending the post-war international order, and resolutely combating the countercurrent that summons the spirit of militarism are not only about respect for history but also point to the future direction of development for the international community and human civilization.
